(American soldier at Gutamono bay) Hello terrioist do you have everything you need? Lets see I have already gotten you better health care then most americans, kept you well fed, gave you a place to sleep, and most importantly haven't killed you or held you ransom, unlike if you would of captured me. Which in that case you would of cut of my limbs, tourtred me, and most likely kill me.
(Terrioist) Well I think I am being treated unfairly, even if I did try to kill you & american citizens. I deserve rights, beause even if I tried or did kill an American and hate their idealolgy, I deserve the right to a fair trial.
(Supreme Court) Very true, here you now can appeal in federal court. I'm sorry terrioist we'll have this mishap cleared up by morning, go home to your nice cell & go to bed on our tax payers money.
Now if you can't tell that was a sarcastic look at this situation, but give me a break!! These people tried to kill me, even if they aren't being treated the best, its not like they were honor roll students sent home for a sexual induendo on their shirt!! I mean come on, thousands of americans & people accross the world have died because of the acts of violence these people have commited. Now these terriosit say they will embrace their martyrdom & will go to heaven for killing people. Don't you see if we let these people go through the law system they can obviously plea for insanity, because their logic is ku koo! Ok that wouldn't happen but when a guy on the first day of his trial, says death to america in his first sentence. Do you think he commited the crime? Hmm... unless they have talked to O.J. I don't know how you can't find an guilty verdict.
So unless you want more of this scenario
(Terrioist prisoner to American Soldier) Waiter I asked for my steak medium rare, this is obviously well-done.
(American soldier) Sorry we will tell paula dean to recook it.
Then we need to say goodbye terrioist we'll excute you & no one will ever know, heck we'll even tell your friends when they call, that you can't come to the phone because your on a vacation. Little will they know with 72 virgins in heaven, which according to lewis black can't be possible because he can't find one.

There are several thnigs wrong with the scenario you present. First, many people imprisoned in Guantanamo Bay are only held on suspicion of being connected to a terrorist organization and many are found to be guilty of nothing more than a case of "wrong place wrong time" syndrome. Those who are held without trial at Guantanmo and then released after a few years of horrible treatment (remember the torture scandal there? Well, it's still not been banned) have a higher chance of joining terrorist groups afterwards because of the anger they feel. By denying their rights, we're CREATING more terrorists, not punishing those who are terrorists.
Furthermore, we allow serial killers who we KNOW killed many people to have a fair trial with a jury of his peers. If you're going based on the idea that those who kill people don't deserve a trial, then maybe we should start with them rather than putting our world image in the toilet by sinking to "their" level?
Finally, quiet frankly your final paragraph scares the heck out of me. Who are we to start executing nationals of other countries without their knowledge or a trial or any confirmed proof of guilt? Isn't that just inviting more attacks, more anger, more terrorists? This isn't a schoolyard where we can yell "They started it!" and just get sent to time-out. If we show that we are so irrational and ridiculously cruel as to treat prisoners from other countries as if they don't deserve the same consideration as our own citizens how long do you think the world is going to take that?
Also, how do you think those countries are going to treat American prisoners that they capture?

Ha I think someone needs to take a course on sarcasm & the use of satire to initiate political change, or at least make a statement on something. I wasn't using facts obviously I could, but the truth is I don't feel sorry for people in that prision. They didn't get there because of their great character traits. The last statement that you made is an interesting one, due to the fact we are not fighting countries barely anymore. No we are fighting terrioist that can operate out of anywhere, and abide by no rules of war. So that means they are exempt from proper treatment.
Without countries harboring terrorists, they would have nowhere to go and a large cut in the funding they draw from. Furthermore, we obviously don't want to START fighting countries and if, god forbid, we commit some horrific act on a national of another country who has done nothing wrong, that could provoke some action on their part. Most likely not a military assault, but Middle Eastern countries especially have huge economical power over us (*cough*oil*cough*).
Besides, our allies don't like us torturing prisoners and flaunting Geneva Conventions any more than our enemies do, and we certainly need all the allies we can get.
Finally, if you want to make a convincing argument, then you're going to need to use some actual facts rather than "sarcastic" scenarios that are so far-fetched as to be unbelievable.
