Habeas Corpus, one of the orignal important ideas that our country was founded on. For those who don't know, habeas corpus is important when someone is being arrested. Bascially the writ of heabeas corpus means that you can not be illegally arrested. The government or law must notify you of why you are being arrested and prove just reason for your imprisonment. As of October 17, 2006 the law and governemt doesn't have to do this and Habeas Corpus means nothing. All because the new Millitary Commissions act of 2006 went into effect. The Millitary Commissions Act allows the government to ignore habeas corpus to arrest anyone who they see as an ''enemy combattant". No longer do these ''enemy combattants'' have a right to know why they are arrested, but they also don't have a right to a speedy trial, don't get to see the vidence against them or choose ther own defense lawyers. They are allowed to be tortured for information, something that our country has always been against but now it is okay, and it is all legal. I believe the government has put the Millitary Commissions Act into effect because of what is currently going on in our world, mainly the war in Iraq. Now the question arises, is it right for our government to put such an act into effect because of current world issues? Our country was founded by people escaping from persecution who wanted to have a government that was fair and just and we even have tried to enforce our values on other countries. Now after all of our struggling to have a fair and jsut government here we are going back on our values in a time when they should be enforced more than ever. Since when was it right to bend the rules in our favor? I was always taught in school that such an idea or act as cheating and in no way was morally correct. I mean I would have had a lot better grades on quizes and tests if I could bend the rules into my favor in certian situations but that doesn't make it morally right, and it isn't right for our country to do it either since our country stands for freedom. Now back to these so called ''enemy combattants''...what in the world are they? Someone who wants to fight who is an enemy? Well who would that include? The vagueness of this act is what really worries me, anyone on the street could be picked up now and be arrested for being an ''enemy combattant'' and they dont even get to know how they are one. I just hope the government doesn't mis-use this act in any way, personally I am against the act in the first place and I think it can only cause trouble for America. If the government is going to instill such an act they should at least be more descriptive about how it is to be used and to whom is will be used against. ''Enemy Combattant''...wtf



I'm freaking out about this act, although rumor has it that it won't actually be utilized. My favorite part is that it allows the US to pick and choose what parts of the Geneva Convention it feels like obeying. Ugh.
How can we lawfully and constitutionally throw out a right that has been ours for centuries, and is still very important to our sense of moral duty? It undermines our country and our court systems as a whole. It makes us seem like faschist dictators.
How can the government go against the pure rights the founding fathers envisioned for us!?
Most people they see as "enemies" aren't even enemies.
It's just an excuse to slowly take away our freedom while we are ignorant to it because it's happening one right at a time for the "protection" of the country.
Our nation's democracy is full of things that require a delicate balance to function properly. One of these is protecting the majority of the citizens vs. infringing upon the rights of the minority. While these kinds of laws may infringe upon rights, they ultimately keep the rest of the population safe.
Also, I disagree with you when you said "anyone on the street could be picked up now and be arrested for being an 'enemy combattant' (sic)." The government simply does not arrest people for no reason--they just don't. Do not act like you are personally being wronged for a law that will never affect you (unless, of course, you are tagged as an enemy combatant). For the government to arrest someone, you can be sure they have reasonable evidence against them.
