Supreme Court Weighs In

The Supreme Court announced a unanimous decision in the case of Military Recruiting on college campuses.  Only Justice Alito did not cast a vote in the 8 – 0 decision because he was not on the bench when the case was argued.  Justice Roberts stated in his opinion, “A military recruiter’s mere presence on campus does not violate a law school’s right to associate, regardless of how repugnant the law school considers the recruiter’s message,”  The decision shot down the argument made by the Universities that they could prevent them from recruiting on campus due to their “don’t ask, don’t tell” policy on gays.  Justice Roberts went on to state in his opinion that congress can pass legislation mandating college campuses to allow military recruiters even if the school does not accept federal funding.  The case is Rumsfeld v. Forum for Academic and Institutional Rights, 04-1152.
