I was pondering while I ate breakfast, the laws in the States now regarding self defense. I've been taught all of my life that I could legally kill someone in my own or somebody elses defense, but then I got to thinking, would this be a viable case nowadays? With the things that lawyers get away with, could they not convince the judge and jury that I had used unneccesary force and had killed the man in cold blood? So I get charged with manslaughter and get put up in jail for what? 20 years? 40 years? Life?
Ok, so what about when someone is robbing your home? You have the right to shoot them right? Well, if you do, make sure that the person's dead cuz there have been law suits that have been won where an injured burglar has sued the person whose house he was breaking into. There was this one burglar who broke into this house while the owners were away on vacation. He took what he wanted in the house and then completed his rounds by slipping into the garage to see what he could pilfer there. Unfortunately for him, there were no windows or other avenues of escape and when he was done looting what he could, he found that the self locking door had shut on him. Long story short, he spent the entire time there until the family got back from vacation. He sued them and won the case...
Sound like injustice? That's cuz it is. Our courts are filled with cases like these and innocent victims are charged with crimes while the real criminals escape. Self defense is the right of all people everywhere. That's why I believe in the second amendment. The people should be allowed to protect themselves.
I'm in Ukraine at this very moment, a place where, legally, only the military are allowed to have guns with rifled barrels and only security companies are allowed to have guns, but only smooth-bore. This doesn't keep people from having guns. Most small criminals just commit their crimes with knives, but the people who have connections, or enough money and are able to get guns, kill using those. The general populace is defenseless against these people. The reason the soviets implemented this is epitomised in the words of Lenin, "The one who holds the gun controls ten people around him.". Gun control is communistic and impedes the self defense of the people. Criminals don't care if it's legal or not, they'll get the guns however they can, they're criminals!(hello...) In the meantime, law-abiding citizens are defenseless cuz they don't want to break the law. Of course people with guns should be taught how to properly use them, which, from what I've seen is happening. It's just people who get guns illegally who don't register them and take classes on them. But banning guns wont keep those people from having guns, it'll just lessen the number of people who are able to resist them.
Ok, I didn't really want to talk about gun control but I guess since it has so much to do with what I was talking about I couldn't help it. Back to the main point. Should people be allowed to kill someone in self defense? Should people be allowed to shoot a burglar in their own house? In my opinion, yes to both...













Shooting an intruder in your house with no warning is ridiculous. The "intruder" could be some 14-year-old kid breaking in as a dare. Could be a 20-year-old college kid stealing. Could be someone really drunk or high or confused. Could be some vagrant just looking for a place to sleep. So many kids break and enter, are you supporting just shooting an intruder without even warning him? Or shooting him as he tries to run from you?
You're right. Some people get shot when they where just in the house for less harmful reasons. In fact, I read this story about a woman who shot her husband thinking he was a burglar. But... the fact is, how are they supposed to know that the person isn't armed or insane. Let's say that the person has a gun as well. If you warn him he might shoot at you. People have to have the right to make those discisions for their own safety...

Wtf? Why on earth would a burglar shoot at you if you warned him? Yeah, he really wants to go to jail for robbery AND murder. O.o
Oh ok so you know the psychology of every burglar. Well some are drunk and or high as you mentioned and are not in their right mind. You just cannot take the chance. They aren't thinking about jail time when they break into your house... and some breakin's are not for burglary, some are for murder... ever heard of home invasion?

I tend to agree with you.
I am an advocate for gun rights; in fact, there are 2 pistols and more rifles than that in my house.
However, it's a completely ridiculous notion to say that it's okay to shoot someone just for breaking and entering.
Weapons should only be used as self defense in the most extreme circumstances under the most extreme threats.
If someone is threatening my life or my body in any way, I know how to use my gun. Otherwise, there's no reason to threaten someone's life.
