Innocent Until Proven Guilty

This is the basis to our legal system, yet American citizens seem to be the worst at upholding this principle. We have the luck of having freedoms that allow us an opinion, but we have gotten too opinionated when it comes to our opinions of a person on trial. When you watch a trial on television, how many times to you make an opinion about whether or not he is guilty based on his/her history, or whether or not you like him/her. I am guilty of this as well, and it needs to stop. While we all have a right to an opinion, we need to base those opinions on facts, because basing them on anything else is wrong and it is something that our court system tried to prevent when they made the phrase "innocent until proven guilty". In essence, they are already convicted before the jury decides. They are convicted in the hearts of everyone who makes an opinion without proving them guilty.

and other countries too, it goes, guilty until you can be proven innocent or that is what i see happening day in and day out with most cases

"Pride is concerned with who is right. Humility is concerned with what is right."

yeah. America is the worst i think, because we have claimed the oppisite, yet we are still pretty much the same as everybody else.

if you are making a decision based on bias instead of know what you are talking about than that can severley hurt the defendent and possibly make it impossible for he/she to win their case.
if you have reviewed the facts and come to your opinion than i believe you are intilted to it wheather the court sides with you or not.

I think so also, and i said that in my blog. If you are to make decisions, make them on evidence and facts. I am guilty of making opinions, but i like to think that i consider both sides and look at facts before i make any decision. Our freedom to spewak our mind also gives us the responsibility to make an educated opinion.

i wish everyone could do that.
others just choose to be ignorant.

but ive noticed that more teens are becoming aware of politics and getting educated opinions. It is at least a start. our generation is very opinionated and at least alot of people i know seem to want to utilize it for the better.

It is the small part of the generation that pulls us down with their narrow mindedness.

I think the media has a lot to do with this. The more a case is known, the more people will talk about it. And whatever people talk about will have an affect on the outcome of the case, one way or another. It's really hard for us not to say whatever we feel though, even if we're DEAD wrong about certain issues.

the media should be an outlet for good information, not opinions, cuz not alot of people get to go to the actual trial. and it also depends on how rich you are or how well known you are for whether ur innocent or guilty. We are all guilty of doing this, but we shouldnt be.

Media manipulates everything though.
Well, the media that most people watch, anyway.
They get the story that is filtered, if they even get the news...

The reason no one follows the innocent until proven guilty stuff is because our courts are based on the failed political law system and not the common law system, which is much more effective.

peacelovechange's picture

Very good point, but most people aren't even familiar at all with English Common Law.

That's because the public schools don't teach it. It's once again the governments fault.

peacelovechange's picture

Actually, I learned about English Common Law in my Business Law class, as well as all of the benefits it would have. I am fortunate though, because I am noticing that my high school taught me a lot of things that others didn't, and the subjects are quite surprising and sadening to me. Some of the best history is covered up by our government.

The government has been covering it up since we started using political law in the 1800's. It's nothing new.

peacelovechange's picture

I know, it's just sad.

We talked about it during class today. lol. kinda ironic. But over time, things have just gotton more corrupted with politics, opinions, government, world dealings, and things like that. We as a people dont realize how much things have changed over time until we look back to the basics of our country. Things have changed alot, good and bad stuff.

The majority of people don't understand how bad they're being screwed by our law system.

People don't care enough to know. Ignorance is not bliss.

the concept of "innocent until proven guilty" that has persisted in the U. S. for so long is slowly fading. Bush has suspended habeus corpus, so now police don't have to tell the person they arrest, the reason for their arrest.
